Terms of Service

1. Definitions

• Service — the TrustYourWebsite website compliance scanning platform at trustyourwebsite.nl.
• Report — any compliance report generated by the Service.
• Free Report — a summary report showing risk score and issue counts, available without payment.
• Detailed Report — a full report with findings, screenshots, and fix instructions, available for €2.50.
• Premium Scan — an in-depth scan with advanced checks and priority processing, available for €9.99.
• Monitoring — ongoing scanning subscription tracking changes over time (€19/month).
• User / You — any person or business using the Service.
• Website — the website submitted for scanning.
• Health Score — a proprietary numerical score calculated by our automated tools, representing a general indication of website compliance. The Health Score is not a legal standard, certification, or guarantee of compliance.

2. Service description

TrustYourWebsite scans publicly accessible websites using automated tools and provides website reports. Reports are informational assessments designed to help you identify potential areas for improvement on your website. They are not legal advice, formal audits, or compliance certifications.

Reports are generated by automated scanning tools and provide a technical assessment of publicly accessible website characteristics. They do not constitute legal advice, a formal compliance audit, or a certification of any kind. The findings may include false positives or miss certain issues. Compliance status may change between the time of scanning and the time you read the report. For a definitive legal assessment, consult a qualified legal professional. Exposure estimates are based on publicly available regulatory guidelines and actual penalties may differ.

3. Nature of the Service — no audit, no legal advice

The Service provides automated website checks for informational purposes only. By using the Service, you acknowledge and agree that:

• Reports are not formal audits, compliance certifications, or legal opinions.
• The Health Score is a proprietary, indicative metric — not a legal standard or benchmark.
• TrustYourWebsite does not guarantee that a website is compliant with any law, regulation, or standard, regardless of the score or findings shown.
• A “good” score or “no issues found” does not mean your website is legally compliant.
• A “bad” score or listed issues does not necessarily mean you are in violation of any law.
• You remain solely responsible for your website's legal compliance at all times.
• Findings reflect a point-in-time snapshot. Websites, regulations, and enforcement practices change continuously.
• You should not rely on our reports as a substitute for qualified legal, accessibility, or security advice.

TrustYourWebsite expressly disclaims any responsibility for actions taken or not taken based on the content of any report.

4. Free report

Every scan produces a free report with a Health Score and issue summary. The free report is available without registration or payment. We make no guarantees regarding the accuracy or completeness of the free report.

5. Paid products

All prices are in euros and include 21% Dutch BTW (VAT). Payment is processed by Stripe. Access is granted immediately upon payment confirmation. Invoices and receipts are provided electronically via email and your account dashboard.

• Premium Scan: €9.99 (one-time)
• Monitoring: €19/month (subscription)

We reserve the right to change pricing. Price changes do not affect previously purchased products. For active Monitoring subscriptions, we will notify you at least 30 days before any price change takes effect.

6. Monitoring subscription terms

The Monitoring subscription renews automatically each month until cancelled. You may cancel at any time via your dashboard or by emailing info@trustyourwebsite.nl. Cancellation takes effect at the end of the current billing period — you retain access until then. No refunds are issued for the current billing period after cancellation. Historical scan data is retained for 12 months after cancellation, after which it is deleted.

7. Right of withdrawal

Under the EU Consumer Rights Directive and the Dutch Distance Selling Act (Wet Koop op Afstand), you normally have 14 days to withdraw from a purchase. However, because our products are digital content delivered immediately, you explicitly waive this right at checkout by confirming:

“I agree that the digital content is delivered immediately and I waive my right of withdrawal.”

8. Refund policy

• Detailed Report (€2.50): no refund after delivery.
• Premium Scan (€9.99): no refund after delivery.
• Monitoring (€19/month): cancel anytime, no refund for the current billing period.

If a report could not be generated due to a technical error on our side (e.g., scan failure), we will either re-run the scan at no extra cost or issue a full refund at our discretion.

9. Acceptable use

By using the Service, you agree to the following:

• You will only submit websites that you own, operate, manage, or have a legitimate business reason to evaluate (e.g., you are considering hiring the website owner, or evaluating a supplier).
• You will not use the Service to harass, threaten, or coerce website owners based on scan findings.
• You will not use reports to extort payments from website owners (e.g., demanding money to “fix” issues you identified via our Service).
• You will not access the Service via automated scripts, bots, or scraping tools without our prior written permission.
• You will not resell, redistribute, or publicly publish reports or scan data.
• You will not attempt to reverse-engineer, decompile, or extract the scanning methodology.

We reserve the right to suspend or terminate access for users who violate these terms.

10. Scanning consent and third-party websites

You represent that you have a legitimate reason to scan any URL you submit. TrustYourWebsite scans publicly accessible information only and does not access any password-protected, authenticated, or otherwise restricted areas of websites.

If you are the owner of a website that has been scanned and you wish to opt out of future scans, contact us at info@trustyourwebsite.nl. We will add your domain to our exclusion list.

11. Outbound scan communications

We may identify business websites through publicly accessible sources (such as business directories, chamber of commerce registers, or your website's contact page) and send a brief scan summary to the business email address listed on your website. This is a one-time B2B communication about a relevant service. You will receive a maximum of one initial email and one follow-up. Every email contains a clear opt-out mechanism. 12. Limitation of liability

TrustYourWebsite is not liable for:

• Business decisions made based on our reports.
• The accuracy, completeness, or timeliness of automated findings — reports may contain false positives, false negatives, or outdated information.
• Third-party actions such as regulatory fines, legal claims, or enforcement actions, regardless of report content or score.
• Any loss, damage, or expense arising from reliance on our reports, scores, or recommendations.
• Indirect, incidental, special, or consequential damages of any kind, including lost profits, lost data, or business interruption.
• Actions taken by third parties in response to you sharing a report.

Our maximum aggregate liability for any claim arising from or related to the Service is limited to the amount you paid for the specific product giving rise to the claim, up to a maximum of €9.99.

Nothing in these terms excludes or limits our liability for fraud, willful misconduct, or any other liability that cannot be excluded under Dutch law.

13. Disclaimer of warranties

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that all issues on a website will be detected.

14. Scanning ethics

We commit to responsible scanning practices:

• We only scan publicly accessible pages.
• We respect robots.txt directives.
• We do not perform destructive actions, submit forms, or attempt authentication.
• We rate-limit requests to avoid impact on target websites.
• We do not store or process any personal data found on scanned websites beyond what is necessary to generate the report.

15. Data processing

For details on what personal data we collect, how we use it, and your rights under the GDPR, please refer to our Privacy Policy. By using the Service, you confirm that you have read and understood our Privacy Policy.

Scan results (URLs, findings, screenshots) are stored for 12 months and then deleted. Payment records are retained for 7 years as required by Dutch tax law.

16. Intellectual property

The scanning methodology, algorithms, Health Score calculation, and report format are the intellectual property of TrustYourWebsite.

Reports are licensed to the purchaser for internal use only. You may share reports with your web developer, IT service provider, or legal advisor for the purpose of addressing findings. Reports may not be resold, sublicensed, or published publicly (including on social media, review platforms, or in marketing materials) without our prior written consent.

17. Changes to these terms

We may update these terms from time to time. Changes will be published on this page with an updated date. For material changes that affect your rights, we will provide at least 30 days' notice via email (for users with an account) or a prominent notice on our website. For active Monitoring subscribers, material changes take effect at the start of the next billing period following the notice period. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

18. Severability

If any provision of these terms is found to be unenforceable or invalid by a competent court, the remaining provisions remain in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the original intent.

19. Force majeure

TrustYourWebsite is not liable for any delay or failure in performance resulting from circumstances beyond our reasonable control, including but not limited to: outages of third-party services we depend on (such as cloud hosting, payment processing, or external APIs), natural disasters, internet disruptions, or changes in law or regulation.

20. Dispute resolution

These terms are governed by Dutch law.

If you are a consumer, you may submit a complaint to us at info@trustyourwebsite.nl. We aim to resolve complaints within 30 days. If we cannot reach a resolution, you may submit the dispute to the Geschillencommissie (sgc.nl) or another recognized alternative dispute resolution body. You also have the right to bring proceedings before the competent court.

If you are a business, any disputes will be submitted to the competent court in The Hague, the Netherlands.

21. Age requirement

You must be at least 18 years old or have the legal capacity to enter into binding agreements to use the Service and purchase paid products.
