Why pre-consent cookies are a problem
Under the Dutch Telecommunications Act art. 11.7a and the GDPR, websites must obtain explicit consent before placing non-essential cookies. Analytics and marketing cookies set on page load — before the visitor can respond to the banner — are the textbook violation.
The Autoriteit Persoonsgegevens has actively enforced this requirement on Dutch websites, and clarified that 'cookie walls' and pre-ticked boxes don't count as valid consent.
Common issues on Dutch sites include Google Analytics loading on page load, Facebook Pixel firing before consent, and banners whose Reject button doesn't actually stop the trackers.
