Terms of Service

Last updated: 7 April 2026

This version is the legally binding version for customers in Ireland.

1. Definitions

  • “We”, “us”, “our”— TrustYourWebsite, operated by a sole proprietorship registered in the Netherlands.
  • “You”, “your”— any individual or business entity using our services.
  • “Service”— the TrustYourWebsite website scanning and reporting platform, including all free and paid features.
  • “Scan”— an automated technical analysis of a website's compliance, security, privacy, and accessibility characteristics.
  • “Report”— the document generated from a scan, containing findings, scores, and recommendations.
  • “Health Score”— a numerical score from 0 to 100 representing the overall technical health of a scanned website, based on weighted findings across compliance, security, privacy, and accessibility categories.
  • “Finding”— an individual issue or observation identified during a scan, classified by severity (critical, high, medium, or low).

2. Service description

TrustYourWebsite provides automated website scanning to help small businesses understand their website's compliance, security, privacy, and accessibility posture. Our scans check for common technical issues and generate reports with findings and recommendations.

Our service provides technical analysis, not legal advice. We are not a law firm, and our reports do not constitute legal counsel. Always consult a qualified legal professional for compliance decisions.

3. Nature of the Service

You understand and agree that:

  • Our scans are automated technical checks, not comprehensive compliance audits.
  • Results represent a snapshot at the time of scanning and may not reflect the current state of a website.
  • We cannot guarantee that all issues will be detected, or that all reported issues are actionable.
  • Our Health Score is a relative indicator based on automated checks, not an absolute measure of compliance or quality.
  • Recommendations are general in nature and may not apply to your specific legal or regulatory situation.
  • We do not access password-protected pages, internal systems, or any content not publicly accessible.
  • Third-party services referenced in our reports (such as SSL Labs or Mozilla Observatory) have their own terms and accuracy limitations.
  • Achieving a high Health Score does not guarantee legal compliance with any regulation, including GDPR, the European Accessibility Act, or any other applicable law.
A clean scan result is not a compliance certificate. Always seek professional advice for legal obligations.

4. Free report

We offer a free scan that provides a Health Score, issue counts by category, and a summary of findings. The free report shows limited detail — specific findings, screenshots, and fix instructions are blurred and only available in paid reports. No account or payment is required for a free scan.

5. Paid products

All prices are in euros and include applicable VAT.

  • Detailed Report (€2.50)— full findings with descriptions, evidence, and fix instructions for a single scan.
  • Premium Scan (€9.99)— everything in the detailed report, plus screenshots, advanced checks, PDF export, and priority scanning.
  • Monthly Monitoring (€19/month)— automated recurring scans with change detection and email alerts when new issues are found.

We reserve the right to change prices at any time. Price changes will be communicated at least 30 days in advance. Active monitoring subscriptions will continue at their original price until the next renewal after the notice period.

6. Monitoring subscription terms

Monthly monitoring subscriptions renew automatically each month until cancelled. You may cancel at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period — no refunds are given for partial months. We may suspend or terminate monitoring if we detect abuse, excessive usage, or violations of these terms.

7. Right of withdrawal

Under the EU Consumer Rights Directive, you normally have 14 days to withdraw from a purchase. However, because our products are digital content delivered immediately, you explicitly waive this right at checkout by confirming:

“I agree that the digital content will be delivered immediately and I waive my 14-day right of withdrawal.”

Without this confirmation, we cannot process your order. This waiver is in accordance with the EU Consumer Rights Directive (2011/83/EU).

8. Refund policy

Because digital content is delivered immediately after purchase, we generally do not offer refunds. However, if a scan fails due to a technical error on our side and we are unable to deliver the report, you are entitled to a full refund. To request a refund, contact us at info@trustyourwebsite.nl within 14 days of purchase, including your order reference and a description of the issue.

9. Acceptable use

You agree not to:

  • Use our service to scan websites you do not own or have authorisation to scan.
  • Attempt to overload, disrupt, or interfere with our scanning infrastructure.
  • Reverse-engineer, decompile, or attempt to extract the source code of our scanning technology.
  • Use scan results to harass, defame, or extort website owners.
  • Resell or redistribute our reports without our written permission.
  • Automate access to our service (scraping, bots) without prior written agreement.

We reserve the right to suspend or terminate access for any user who violates these terms.

10. Scanning consent and third-party websites

By submitting a URL for scanning, you represent that you have the right to scan that website, or that the website is publicly accessible and you are requesting a technical analysis of its public-facing characteristics. Our scans only access publicly available pages and resources — we never attempt to bypass access controls, authentication, or robots.txt restrictions.

We are not responsible for the content, accuracy, or practices of third-party websites that are scanned using our service.

11. Outbound scan communications

We may send unsolicited scan reports to businesses via email as part of our outreach activities. These emails are sent on a business-to-business (B2B) basis to email addresses obtained from publicly accessible sources (such as business directories, chamber of commerce registers, or your website's contact page).

Each business will receive a maximum of one initial email and one follow-up. Every email contains a clear opt-out link. If you opt out, we will never contact you again, and your email address will be added to our permanent suppression list.

12. Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our service.
  • We are not liable for any decisions you make based on our scan results or recommendations.
  • We are not liable for any damages resulting from inaccurate, incomplete, or outdated scan results.
  • We are not liable for any downtime, service interruptions, or data loss.
  • We are not liable for any third-party actions or omissions related to websites you scan.
  • Our total aggregate liability for any claim related to our service is limited to the amount you paid us in the 12 months preceding the claim, up to a maximum of €9.99.

Nothing in these terms excludes or limits our liability for fraud, willful misconduct, or any other liability that cannot be excluded under Irish law.

13. Disclaimer of warranties

Our service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our service will be uninterrupted, error-free, or that scan results will be complete or accurate.

14. Scanning ethics

We commit to ethical scanning practices:

  • We respect robots.txt directives and do not crawl pages that website owners have excluded.
  • We limit our request rate to a maximum of one request per second per domain, with random delays between requests.
  • We never modify, submit forms on, or interact destructively with scanned websites.
  • We identify our scanner with a clear user-agent string when technically feasible.
  • Website owners can contact us at any time to request that their site be excluded from future scans.

15. Data processing

We process personal data in accordance with our Privacy Policy. By using our service, you acknowledge that you have read and understood our privacy practices.

Scan results are stored for 12 months. Payment records are retained for 7 years as required by Dutch tax law.

16. Intellectual property

All content, software, algorithms, designs, and branding associated with TrustYourWebsite are our intellectual property or used under licence. You may not copy, modify, distribute, or create derivative works from our service without our prior written consent.

Scan reports you purchase are licensed for your own use. You may share them with your team, contractors, or advisors, but you may not resell them or use them for commercial redistribution.

17. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via our website or by email to registered users. Your continued use of our service after changes take effect constitutes acceptance of the revised terms. We recommend reviewing this page periodically.

18. Severability

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

19. Force majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, power outages, internet disruptions, government actions, or third-party service failures.

20. Dispute resolution

These terms are governed by Irish law for consumers resident in Ireland.

For consumers: If you are a consumer, you may submit a complaint to us at info@trustyourwebsite.nl. We aim to resolve complaints within 30 days. You may also contact the Competition and Consumer Protection Commission (ccpc.ie) for guidance. For claims up to €2,000, you may use the Small Claims Court procedure. You also have the right to bring proceedings before the competent court.

For businesses: If you are a business, any disputes will be submitted to the competent court in The Hague, the Netherlands.

21. Age requirement

You must be at least 18 years old to use our service or make a purchase. By using our service, you confirm that you meet this age requirement.
