Why pre-consent cookies are a problem

Under the Irish ePrivacy Regulations (SI 336/2011) and the GDPR, websites must obtain explicit consent before placing non-essential cookies. Analytics and marketing cookies set on page load — before the visitor can respond to the banner — are the textbook violation.

The DPC's cookie sweep of Irish websites found the large majority non-compliant and warned that enforcement follows — pre-consent trackers were the most common finding.

Common issues on Irish sites include Google Analytics loading on page load, Facebook Pixel firing before consent, and banners whose Reject button doesn't actually stop the trackers.
