Why pre-consent cookies are a problem
Under the GDPR and ePrivacy Directive, websites must obtain explicit consent before placing non-essential cookies on a visitor’s device. This means no tracking cookies, analytics cookies, or advertising cookies until the visitor clicks “Accept” on your consent banner.
Data protection authorities across the EU — coordinated through the EDPB — treat cookie consent as an enforcement priority, and the CJEU's Planet49 ruling confirmed that pre-ticked boxes and implied consent are invalid.
Common issues include Google Analytics loading on page load, Facebook Pixel firing before consent, and session replay tools like Hotjar recording without permission.
